Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and EdTechAI Apps LLC ("Company," "we," "our," or "us") governing your access to and use of the Bloom mobile application (the "App") and related services (the "Services").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

You must be at least 13 years of age to use the Services. Users between 13 and 18 (or the age of legal majority in your jurisdiction) may only use the Services with the consent and supervision of a parent or legal guardian who agrees to these Terms.

Bloom provides adaptive test-prep and cognitive training experiences including assessments, personalized exercises, progress tracking, performance analytics, and optional email communications.

Access to certain features requires a paid subscription. Pricing and plan options are displayed in the App at the time of purchase. Promotional pricing may be offered from time to time and is subject to change.

Billing. Payments are processed through Apple's App Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Free trial. If your subscription includes a free trial, you will not be charged during the trial. Your subscription converts to paid at the end of the trial unless you cancel first.

Cancellation. You may cancel any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.

Price changes. We may modify subscription prices. Changes apply to subsequent billing periods after notice.

The App, including all content, features, functionality, design, graphics, logos, trademarks, exercises, algorithms, and user interface, is owned by EdTechAI Apps LLC and protected by U.S. and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control for personal, non-commercial use. You may not copy, modify, distribute, sell, reverse engineer, or use the App for commercial purposes without our written consent.

You agree not to:

• Use the Services for any unlawful purpose.
• Interfere with or disrupt the Services or servers.
• Attempt unauthorized access to any portion of the Services.
• Transmit viruses, malware, or other harmful code.
• Impersonate any person or entity.
• Share your account credentials with others.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Educational disclaimer. Bloom's exercises, assessments, and score projections are for general educational and entertainment purposes. They are not clinically validated diagnostic tools and are not intended to diagnose, treat, or prevent any medical or cognitive condition.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDTECHAI APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless EdTechAI Apps LLC from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services or your violation of these Terms.

The App integrates with third-party services (such as the Apple App Store and email providers) that are governed by their own terms and privacy policies. We are not responsible for their content or practices.

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Provisions that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Delaware without regard to conflict of law provisions. Disputes will be resolved through binding arbitration administered by the American Arbitration Association on an individual (non-class) basis.

We may modify these Terms at any time. Material changes will be noted with an updated "Last Updated" date. Continued use of the Services after changes constitutes acceptance.
